The ground rules for using this site, what the information here is and is not, and how a fixed price agreement with us comes into effect.
1Using this website
This website is operated by Ironbark Legal Pty Ltd. By using it you agree to these terms. If you do not agree, please do not use the site.
You may view, download and print pages for your own personal and non commercial use. You must not copy, reproduce, republish or redistribute any part of the site, including the illustrations and photographs, without our written permission.
2Information is general, not legal advice
The content of this website is general information about the law in Victoria and about our services. It is not legal advice and does not take into account your particular circumstances. The law changes, and general information may not apply to your situation.
Do not act, or refrain from acting, on the basis of anything on this site without first obtaining advice from a lawyer about your specific matter. Booking a consultation with us is the right way to get that advice.
3No lawyer and client relationship
Sending an enquiry through this website, booking a consultation or attending a free first consultation does not by itself make you a client of the firm. A lawyer and client relationship is created only when we confirm in writing that we will act for you, normally in a fixed price agreement that sets out the scope of the work.
Until then we may not have completed a conflict of interest check, and we are not obliged to act for you or to take any steps on your behalf, including steps subject to a time limit.
4Fixed price agreements
Where we agree to act for you, the price and scope of the work are set out in a written fixed price agreement. The agreement describes what is included and what is excluded. Work outside the agreed scope is not commenced without a further written agreement and your approval of the price for it.
The fixed price does not change because a matter takes longer than expected
Court filing fees, search fees and other third party costs are listed separately and passed on at cost
Where no win no fee terms apply, the fee payable on success is fixed in the agreement rather than calculated by time
If anything on this website appears inconsistent with your fixed price agreement, the agreement prevails.
5Accuracy and third party content
We take care to keep the content of this site accurate and current, but we do not warrant that it is complete, error free or up to date at any particular time. Links to other websites are provided for convenience only. We do not control those sites and are not responsible for their content or privacy practices.
Client stories and reviews on this site describe the experience of individual clients. Every matter is different and past results are not a guarantee of future outcomes.
6Intellectual property
All content on this website, including text, layout, illustrations, photographs, the Ironbark Legal name and logo, is owned by or licensed to Ironbark Legal Pty Ltd and protected by Australian and international copyright and trade mark laws. Nothing on this site grants you a licence to use any of that material other than as set out in these terms.
7Liability
To the extent permitted by law, we exclude all liability for any loss or damage arising from your use of, or reliance on, this website or its content. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded.
Liability of the firm in respect of legal services is limited by a scheme approved under Professional Standards Legislation.
8Privacy and communications
We handle personal information collected through this website in accordance with our privacy policy. By submitting an enquiry you consent to us contacting you by phone or email about your enquiry.
Email and web forms are not guaranteed to be secure or free of errors. Please do not send us sensitive documents through the enquiry form. We will arrange a secure way to receive them once we are in contact.
Details of what we collect, why, and how to access or correct it are in our privacy policy.
9Governing law and changes
These terms are governed by the laws of Victoria, Australia, and you submit to the non exclusive jurisdiction of the courts of Victoria. We may update these terms at any time by publishing a revised version on this page. Your continued use of the site after a change is taken as acceptance of the revised terms.
